Public procurement records can establish a lot, but only about what has been published.

Under the Procurement Act 2023 regime, the central digital platform makes procurement notices and related public data visible. Those records can establish buyer-published facts such as the authority, notice type, dates, stated values, locations, award information and linked public lifecycle events where those fields exist.

Jurisdiction boundary

Procurement rules and publication routes can differ across devolved authorities. Scottish procurement legislation continues to apply to devolved Scottish authorities, while the Procurement Act 2023 sets out how reserved, devolved and transferred procurement is treated elsewhere. Buyer tender documents can establish the terms the buyer has actually published.

A notice can lead to associated tender documents that contain the specification, timetable, conditions of participation, award criteria and other buyer-published requirements. For supplier review, the latest issued version matters more than a detached summary.

Clarifications and amendments can change the public picture you started with.

During a competitive tendering procedure it can be necessary to amend or clarify the tender notice or associated tender documents. Current guidance specifically recognises circumstances such as a supplier clarification question leading to an amendment or information having been omitted.

Freshness principle

A saved copy can become stale. If the buyer republishes or reissues affected material, assumptions based on the earlier version may need to be checked again.

Award and contract records can extend the public story beyond the tender.

Where the relevant rules apply, public records can show the intended award, the contract that was entered into and later contract-management events such as performance information, change, termination or payment information. These are useful records of public events. They do not by themselves explain every operational reason behind those events.

None of those sources can fully establish your organisation's current operating reality.

This is the boundary that matters for Pre-Bid Commercial Intelligence. A tender can state a mobilisation period. It cannot know whether your current team has capacity, whether the evidence you need is current, what other commitments you are carrying or which internal assumptions still need confirmation.

Do not manufacture certainty

If the public source cannot establish a supplier-specific fact, the honest state is supplier-provided or unresolved. Public transparency is a starting point, not permission to infer the supplier's private reality.

Source authority, retrieval date and unresolved information are part of the analysis.

Authority and freshness are different questions. A buyer document may be the authoritative source for a requirement, while a later clarification or updated document makes an earlier copy stale. A public record may also be absent even though an event occurred under a rule or system that did not require that record.
